A trademark is something that distinguishes a particular product/service from others within the market. It is a sign which can distinguish goods and services from those of competitors. Lasts 10 years and can be renewed.
A trademark can be:
- A word or name
- A logo
- A slogan
- A design
- In certain cases it can be extended to a color scheme, a smell or a sound.
Objectives of Trademark:
- To prevent confusion among consumers as to the source of goods/services.
- To protect the goodwill that the trademark owner has built up in his/her products/services.
- Can be used as a marketing tool so that customers can recognise your products or services.
Trademarks can not be freely registered and will be investigated thoroughly before registration is approved. The ‘R’ symbol stands for registered trademark (RTM) and can only be used by the owner of the trademark. A company can use the ‘™’ symbol, but this does not mean the trademark has been registered.
